Terms & Conditions

So this is the part that no one reads but we have to have and you need to agree to. Have your partner, lover or wanna-be hipster housemate create one of those rustic cheese boards that they have been posting on Pinterest of late, while you and I work through this. Here we go.

This was last updated on 01/09/2015. Which means, we will update it again and reserve the right to modify or replace these Terms at any time. Not because we feel like it, we are not high maintenance like that, it’s just we may have to. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. That said, if the hot tech nerd who has taken a liking to the Ari Sauvignon Blanc is a bit under the weather it may take a few more days. By the way, we have to decide what constitutes a material change and apparently our lawyer tells us that’s totally up to us.

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) very well before using Vandenbergwines.com website (the “Service”) operated by Friends of Friends Pty Licence No. 51405774
(7089 Riddoch Highway, Padthaway South Australia 5721), because honestly your access to and use of the service is conditioned on your acceptance of and compliance with these Terms and we would hate you to use something you don’t agree with. C’mon you like wine, as if you are going to disagree.

These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. To put it bluntly – if you disagree with any part of the terms then you may not access the website….remember the wine thing.

Termination – We may terminate or suspend access to our Service immediately, without prior notice or liability for any reason whatsoever, including without limitation, if you breach the Terms. All provisions of the Terms, which by their nature should survive termination, shall survive termination including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability. That’s a lot of legalise (we all have mates that are lawyers, this sentence is just to remind you how annoying they are).

Our Service may contain links to third party websites or services that are not owned or controlled by Limestone Coast Wines Pty Ltd. Limestone Coast Wines Pty Ltd can’t really do much about them and assumes no responsibility for the content, privacy policies, or practices of any third party websites or services. It’s a bit like us being responsible for your ice cream eating, sticky hands nephew, just cos you sat them next to us on the park bench while you checked your insta feed– that’s hardly fair.

You further acknowledge and agree that Limestone Coast Wines Pty Ltd shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with, use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third party websites or services that you visit (though not all make for as good a reading).

Site Contents – We employ some super cool designers and amazing illustrators, it’s part of what you like about us and we do this because they are better at that creative stuff than us or you. So the Design of this site, the entire site map, all materials that are part of the site and its contents, are copyrights, trademarks, or other intellectual properties owned, controlled or licensed by Limestone Coast Wines Pty Ltd or its affiliates. You may copy other contents displayed on the site for your personal, non-commercial use only. By all means Pin it or Instagram it but attribute it to the right people and we will get along just fine. No right, title or interest in any contents is granted or transferred to you as a result of any such copying. Except, as noted above, you may not reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, any of the contents or the site. Unauthorised use of the contents is expressly prohibited by law, and may result in severe civil and criminal penalties. Take that part seriously as we are not bad people but we do have a business to run.

Comments & Feedback – we absolutely want your feedback, we do, I am not even making that up, you are now part of the Vandenberg Team so own that. However, that does not mean we accept confidential (ie: all your side of the family secrets), or proprietary information. Accordingly, all comments, feedback, ideas, suggestions, materials, information, concepts, know-how, techniques, and other submissions disclosed, submitted or offered to Vandenbergwines.com using this site or otherwise (this means comments) are not confidential and will remain the property of Limestone Coast Wines Pty Ltd and our affiliates. I think this means if you want to send it to us, you don’t own it and we may use it.

Comments submitted by you must not violate any right of any third party, and must not contain any unlawful, threatening, libellous, defamatory, obscene, scandalous, inflammatory, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate the law. Limestone Coast Wines Pty Ltd assumes no responsibility or liability arising from the content, defamation, libel, slander, omission, falsehood, obscenity pornography, profanity or danger contained in any information posted on our service.

Governing Law – We are from the land down under; you know when women glow and men plunder… it’s not as cowboy as you might think, we have had a conservative government for a while…. These Terms shall be governed and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. By the way if we do fail to enforce any right or provision of these Terms it’s not actually considered a waiver of those rights – you have had a girlfriend or one of those A-type bosses before right, you know how the ‘one person is always right’ thing goes? If any provision of these Terms is held to be invalid or unenforceable by a court, (unlikely you should see how much we pay our lawyers) the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

If you do not agree to the new terms, please stop using the Service – but hey, I would prefer to talk about it so please Contact Us if you have any questions about these Terms.
